Voters in the United States are nearing the end of what’s generally referred to as ‘the silly season.’ Over the next two months, voters will get bombarded with unrealistic promises, lies, conspiracy theories, sickening innuendos, and much more.
Not surprisingly, X’s boss, Elon Musk, appears to be the most well-known public figure leading a smear campaign against the Democrats. In one of his absurd posts on X, Musk stated that if the Democrats win in November, freedom of speech will end.
As informed voters, it’s essential to see through Musk’s misleading claims. We know that freedom of speech is a cornerstone of our democracy, enshrined in the U.S. Constitution.
Our freedom of speech is not a mere suggestion; it’s a fundamental right protected by the First Amendment, adopted on December 15, 1791, as part of the Bill of Rights. The First Amendment states:
“Congress shall make no law… abridging the freedom of speech, or freedom of the press…”1
This amendment guarantees individuals the right to express their ideas and opinions without government interference. However, some limitations exist, such as speech that incites illegal actions, actual threats, and defamation.
While it’s true that lawmakers have the power to change the Constitution, it’s not as simple as Musk would have you believe. It’s a complex process that requires significant support.
Article V of the Constitution outlines the process for amending it, which requires a two-thirds majority vote in the House of Representatives and the Senate. It is a safeguard that ensures any changes to our Constitution are not made by the whims and fancy of a few people.
